Name change for UK expats and overseas residents

Last reviewed August 2026UK Deed Poll Bureau Editorial Team6 min read

General UK name-change information, not individual legal advice. Requirements can vary by organisation and UK jurisdiction; where a decision matters, check the relevant official guidance.

Quick summary

UK expats and overseas residents can apply for and witness a UK deed poll from anywhere in the world — the document is a UK instrument under common law. Common-law countries typically accept it directly; civil-law countries may require an FCDO apostille or a local notarial act. UK records (passport, DVLA, HMRC, banks, GP) can be updated while abroad.

UK deed poll validity abroad

A UK unenrolled deed poll is a UK legal document. Its recognition abroad depends on the destination country:

  • Common-law jurisdictions (Ireland, US, Canada, Australia, New Zealand, most Commonwealth): direct recognition. All that's normally required is the original signed certificate with apostille for some formal foreign-records uses.
  • EU civil-law jurisdictions (France, Germany, Spain, Italy, Netherlands): often require a notarial act called a "statutory declaration of change of name" or local equivalent; an apostille on the UK deed poll is helpful.
  • Asia / Middle East / Latin America: variable. Apostille is widely required; consular legalisation may be needed for non-Hague countries (e.g. UAE).

See our witnessing guide for those without UK contacts for the witnessing route abroad.

FCDO apostille process

An apostille is the international legalisation stamp under the 1961 Hague Apostille Convention. To apostille your deed poll:

  1. Have a UK notary public (or solicitor) certify a copy of your signed deed poll.
  2. Submit the notary-certified copy to the FCDO Legalisation Office via gov.uk/certify-a-document.
  3. Pay the FCDO fee (£30 per document in 2026, plus postal surcharge).
  4. FCDO apostilles the notary's signature; the apostilled copy is now a public document under the Convention.

Some users apostille the original certificate via a Notary's notarial certificate on it (more expensive; ~£75-£200). For most overseas record updates, the apostilled notary-certified copy is enough.

Updating UK passport while abroad

Apply via the standard HM Passport Office online process for overseas applicants. You will need to send your original deed poll certificate and current passport to HMPO; processing for overseas passport updates is typically 6-10 weeks. See gov.uk overseas passport applications.

For updating your local identity documents abroad (driver licence in destination country, local national insurance number equivalents, local tax records), consult the destination country's guidance. The apostilled UK deed poll is the document you submit.

Foreign records updates

UK records (passport, DVLA, HMRC, bank accounts in UK-providers, NHS, GP) can all be updated from abroad — most banks accept a scanned certified copy by post. Many expats maintain UK bank accounts and HMRC personal tax accounts via online services.

For destination-country records (foreign driver licence, tax record, social security), the apostilled deed poll is the proof of name change. The destination country's record-keeper may require an in-country translation; some require a separate court procedure to recognise a non-national name change.

For UK birth certificates: deed poll change doesn't alter a UK birth certificate (the certificate is a historical record). The chain from birth name to current name is shown via the birth certificate plus deed poll(s). See our birth certificate guide for details.
